Standard Contractual Clauses Update

This section contains important information if you signed Egress’ Data Processing Addendum before September 27, 2021. 

Does Egress use the Standard Contractual Clauses?

We include both the European Commission’s (EC) Standard Contractual Clauses (SCCs) and the United Kingdom’s (UK) addendum in our Data Processing Addendum (DPA) by default.  This is in order to ensure that to the extent that there are any transfers transfers of personal data outside of the European Union and/or United Kingdom as a result of a customer’s specific use of our Services then these are appropriately protected as required by law.

The DPA is referred to within our Master Subscription Agreement (MSA) in Section 6 and is incorporated by reference.  Some customers choose to sign our DPA through the Docusign journey available from our legal hub.  

What are the SCCs and why have they been updated?

The SCCs are one way that a transfer of personal data made from the EU or the UK can be protected.  Both the EU and UK versions of the General Data Protection Regulation (GDPR), require that any transferred personal data is given an “adequate level of protection”, in part to ensure that the rights of individual data subjects in their data are maintained.

The previous versions of the SCCs pre-dated the introduction of the GDPR in 2018 and were around 10 years old.  As a result, the updated versions released in 2021 ensure that the SCCs continue to work alongside the GDPR and also address the requirements raised by the ruling in Data Protection Commissioner v. Facebook Ireland Limited, Maximillian Schrems (C-311/18) – commonly referred to as Schrems II

When do you need to update your DPA by?

All DPAs and customer contracts signed before September 27, 2021 must be updated to ensure that they are using the up-to-date SCCs.  This must be completed by December 27, 2022
